Amatista LLC is a Georgia limited liability company doing business as Amatista Creatives (DBA). All references in these Terms to "we," "us," "our," "Amatista Creatives," or the domain https://amatistacreatives.com are to Amatista LLC. We are doing DBA as Amatista Creatives.

By using https://amatistacreatives.com, submitting a form, opening a demo link, or contacting Amatista LLC DBA Amatista Creatives, you agree to these Terms of Service.

You agree not to misuse the website, interfere with its security, scrape private demo pages, submit unlawful content, or use the site in a way that harms our systems, clients, prospects, or service providers.

You must be at least 18 years of age to use https://amatistacreatives.com, to submit any form, to opt in to SMS or email communications, or to enter into any service agreement with Amatista LLC DBA Amatista Creatives. By providing a phone number, email address, or any personal information through our forms, you confirm that you are 18 years of age or older.

We do not knowingly collect personal information, capture SMS opt-in consent, or send marketing or transactional text messages to anyone under the age of 18. If we become aware that we have collected personal information from a person under 18, we will delete that information and revoke any associated SMS consent without delay.

If you are a parent or guardian and believe that a person under 18 has provided us information, please contact us at management@amatistacreatives.com and we will take immediate action.

Demo websites, mockups, audits, and preview links are examples of possible creative direction. They are provided for review and business development purposes unless a written agreement says otherwise.

A preview or proposal does not guarantee specific rankings, leads, revenue, ad approval, platform approval, or business outcomes.

Paid work begins when both sides approve the scope, timeline, and payment terms in a proposal, invoice, statement of work, or written agreement.

Clients are responsible for providing accurate business details, approvals, access, brand assets, legal permissions, and feedback needed to complete the work.

Fees, billing dates, deposits, retainers, cancellation terms, and refund rules are controlled by the written agreement for the project or service.

Unless a written agreement says otherwise, completed work, strategy, research, design direction, setup, and production time are not refundable once delivered or substantially performed.

Amatista LLC DBA Amatista Creatives sends two categories of text messages to people who opt in on a web form at https://amatistacreatives.com: non-marketing service messages about your spec website preview, appointment confirmations and reminders, proposal delivery, project status updates, and post-project review requests; and marketing messages about special offers, discounts, and service updates. Consent for each category is captured separately on the form, and either category can be enabled or disabled independently.

You can cancel the SMS service at any time. Just text "STOP" to +1 (240) 220-4446. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies with your engagement — typically two to six messages per project for service notifications and up to a few per month for marketing communications. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

When you provide an email address or phone number on our forms, you authorize us to respond by email and by voice phone call about your inquiry, demo, proposal, or active services, even if you have not opted in to SMS. You may ask us to stop contacting you at any time by replying to any email or by emailing us directly.

Our website, strategy, copy, designs, code, demos, processes, templates, and creative materials are owned by Amatista LLC (DBA Amatista Creatives) or its licensors unless transferred in a written agreement.

Client-owned materials remain the client's property. Final ownership or license rights for paid deliverables are defined in the applicable written agreement.

Our website and services may depend on third-party platforms such as hosting, analytics, automation, GoHighLevel, LeadConnector, payment, email, CRM, advertising, and social platforms.

We are not responsible for outages, policy changes, data practices, fees, or service limits controlled by third-party providers.

The website and demos are provided on an as-available basis. We work carefully, but we do not promise uninterrupted operation, error-free content, or a particular commercial result.

To the fullest extent allowed by law, Amatista LLC will not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the website or services.
